The veteran guitarist filed a lawsuit against the band last year claiming they wholesale ripped of his 2004 song, 'If I Could Fly', on 'Viva La Vida'. Coldplay denied the claim and there was a whole lot of behind-the-scenes action as lawyers did their thing. Given how similar the two songs sounded, it was assumed that both parties would come to some sort of private agreement. Turns out that wasn't the case and Coldplay's lawyers have now gone on the offensive.
Appearing in a Los Angeles court this week, lawyers for the UK band argued Satriani's song “lacks originality” and the similarities between the two songs are not "significant enough" to award damages. Satriani's legal team muttered darkly and said that was a common tactic to adopt in copyright infringement lawsuits.
Chris Martin talked about the case on radio last year and said that any similarities were "coincidence" and that they did not knowingly copy anything. Of course, to admit anything else would obviously be incriminating.
We'll keep you posted.
